Welcome to Catalyst Education and Career Pathways (“Catalyst”) Website (“Website”)! Catalyst is a team of dedicated educators who are excited to host a Website that serves as a community hub and a meeting place to inform, discuss, and celebrate education. This Agreement sets forth the terms and conditions that apply to students, families, educators, stakeholders, and users (“Visitors”) accessing the Website. Please read this page carefully. Please exit this Website if this Agreement is not acceptable. By using this Website, Visitor agrees to the terms and conditions in this Agreement and consents to be bound by the terms and conditions in this Agreement. Catalyst reserves the right to modify, change, add to, or remove portions from (“Update”) this Agreement at any time in our discretion. Updates are valid upon publication on this page. Please check this page periodically for notice of Updates. Please discontinue use of this Website if Visitor does not consent to Updated Agreement.
V. Registration and Getting an Account In order to become a member of the Catalyst Website community and post content, update material, or communicate with other Visitors, a Visitor must register and create an account.
While Catalyst does not charge for access to this Website, if Visitor is using the internet through a device or data access plan that incurs charges or fees, Visitor agrees that Visitor is responsible for all data charges incurred.
VI. Account Security
Visitor is responsible for account security. This means keeping password and login information private. Do not give browsers with bad intentions (“Hackers”) the chance to pretend to be you and post inappropriate or embarrassing content. Besides your pride and reputation, if the Hacker violates this agreement, your account may be deleted and your access to this Website blocked.

The Catalyst Website Privacy Policy located here, is an important part of this Agreement. Please read the Privacy Policy. This Website is not intended for children under the age of thirteen (13). If you are under the age of eighteen (18) read this Agreement and the Privacy Policy with your parent or guardian. Catalyst complies with the Children’s Online Privacy Protection Act, or COPPA.
VIII. Submissions
Catalyst welcomes suggestions and comments regarding this Website from Visitors. Any comments or suggestions submitted to this Website or Catalyst, either online or offline, will become property of Catalyst upon submission. This clause is intended to avoid the possibility of future misunderstandings for projects and enhancements developed by Catalyst.

Notices or other communications are considered delivered upon actual receipt if delivered personally, by email, or by a nationally recognized overnight delivery service; or at the end of the third business day after the date of deposit, if deposited in the United States mail, postage pre-paid, certified, return receipt requested.

• Visitor’s breach of any term or condition of this Agreement;
• Visitor’s violations of applicable laws, rules or regulations in connection with the use of this Website;
• violations of Visitor obligations of privacy, possession, or use or information to any third party; and
• any claims with respect to acts or omissions of any third party in connection with this Website.
Catalyst shall provide written notice of any claim, suit or action from which Visitor must indemnify Catalyst. Catalyst will cooperate as reasonably required in the defense of any claim. Catalyst reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification.
XVII. Arbitration and Governing Law
Any dispute or claim, except those within the jurisdiction of small claims court, that arises out of or that relates to:
• this Agreement, or
• to the interpretation or breach thereof, or
• to the existence, validity, or scope of this Agreement,
shall be resolved by arbitration in accordance with the then effective arbitration rules of (and by filing a claim with) Arbitration Service of Portland, Inc. Visitor and Catalyst expressly reserve the right to resolve disputes in small claims court. Judgment upon the award rendered pursuant to such arbitration may be entered in any court having jurisdiction thereof. The venue for any dispute resolution shall be Multnomah County, Oregon.
Catalyst acknowledges that mediation usually helps parties to settle their dispute. Therefore, any party may propose mediation whenever appropriate through the organizations named above or any other mediation process or mediator as the parties may agree upon.
This Agreement and all rights thereunder, and any controversies or disputes arising with respect thereto, will be governed by and construed and interpreted in accordance with the laws of Oregon, applicable to agreements made and to be performed entirely within such State, without regard to conflict of laws provisions thereof that would apply the law of any other jurisdiction.
